Els delictes sobre el patrimoni arqueològic

[cat]Els delictes sobre el patrimoni històric i arqueològic continuen sent un tema de gran actualitat. Una legislació lenta i a remolc de les espoliacions un cop produïdes i la pròpia societat que no és prou conscient de l' importància del seu patrimoni històric i arqueològic, en són factors determinants. La legislació s'ha volgut apropar a les realitats dels delictes sobre les pràctiques arqueofurtives o espoliadores del patrimoni històric i arqueològic, però no ho ha pogut concloure. El legislador és lent en relació a l'evolució de la societat i aquesta no és prou conscient de l' importància que té el seu patrimoni cultural i sobretot del fet que li pertany. Poques causes contra delictes de patrimoni acaben amb sentències i això és preocupant. Cal analitzar els motius i les mancances que ho provoquen. Es troba a faltar una especialització en aquest àmbit en l' Administració de Justícia entre d'altres institucions.

[eng] The historical and cultural heritage crimes are still current issues nowadays. On one hand the legislation is slow and it acts after the spoliation occurred, on the other hand the attention that societies give to the historical and archaeological heritage is not proportional to their value. The legislation tried to regulate this kind of crimes but it has not been successful. The legislator is slow compared to the evolution of society and it is not enough aware of the importance of the cultural heritage, the society is not conscious that the cultural heritage belongs to it. The problem is that a few lawsuits resolve with a sentence. It is necessary to analyze the reasons that cause it. There is a lack of specialisation in this field in the Justice Administration among other institutions.
