[eng] Contractual justice has been propelled by the new European contractual law through the coming up of new instruments as unfair advantage or hardship, which are put in place as contract balancing mechanisms. The purging of the contractual disequilibrium could be achieved, not only through the invalidity of the iter contractus, but also via the conservation of the contractual relationship thanks to the inter partes renegotiation, or the judicial adaptation of the contract. The last mentioned principles are to maintain the validity and integrity of the contract. The principles of good faith and contractual equilibrium emerge also as new governing principles that lead to moral arguments concerning private law and, at the same time, the possibility to redraft and maintain the contractual equilibrium. |
