Nota sobre les bases de l'autonomia política de Catalunya fixades en el nou Estatut.

Abstract

En su configuración, el modelo autonómico ampara la existencia de diferencias estructurales entre comunitades, debidas a factores estructurales como la historia, la lengua, los símbolos o la organización territorial. Se trata, pues. no de simples peculiaridades o rasgos secundarios dentro del sistema autonómico general, sino de elementos que resultan decisivos para explicar la existencia de la autonomia misma. Todos ellos, identificadores y diferenciadores, se encuentran recogidos en el título preliminar del nuevo Estatuto de autonomía de Catalunya (2006), pero también se concretan en otras disposiciones, de carácter competencial e institucional que, en buena parte, son triburias de las primeras. Estas disposiciones comportan la existencia de ciertas especialidades en el sistema organitzativo e institucional interno catalán, pero también en el sistema de reparto competencial entre Catalunya y España, lo cual no implica, segun el Tribunal Constitucional, ningún tipo de desigualdad respecto del resto de comunidades autónomas. Esto mismo es lo que permite representar Catalunya a través de unos símbolos nacionales específicos (bandera, fiesta e himno), susceptibles de la misma protección jurídica que corresponde a los símbolos del Estado. O a través de los derechos històricos del pueblo catalán, que son fundamento del autogobierno de Catalunya y de los que se deriva el reconocimiento de una posición singular de la Generalitat en determinados ámbitos com el derecho civil, la lengua, la cultura, y el sistema institucional, además de la consagración de un régimen lingüístico singular.

In its configuration, the autonomic model protects the existence of structural differences among communities. These differences are due to structural factors (history, language, symbols, territory organization) which, at the same time, cause unevenness between autonomous communities. These aren’t only peculiarities or distinguishing features in the general autonomic system, because some of them are decisive to explain the existence of that automy. All these identifying and distinguishing elements are gathered in the preliminary title of the new Catalonia’s Statute of Autonomy (2006) and also, in other institutional and competence provisions that are a consequence of the first. These provisions concern in the one hand, certain specialities in the internal organizational and institutional catalan system, but also in the system of provisions distribution. But according to the Constitutional Court, this doesn’t imply any type of inequality among communities. This allows to represent Catalonia through some specific national symbols (flag, national day and hymn) which might have the same juridical protection as the spanish symbols. Or through historical catalan rights which are the bases of the catalan self government and from which the recognition of a singular position of the La Generalitat in concret areas derives, as the civil code, language, culture and the institutional system. Also, it implies the establishment of a singular linguistic system.
