Abstract
[spa] No cabe duda que el sector bancario ha sido uno de los más
afectados por los constantes cambios legislativos en materia de
consumo propiciados, en muchos casos, por la copiosa jurisprudencia
que se ha pronunciado sobre distintos aspectos asociados a las
reclamaciones de los clientes de banca (participaciones preferentes,
cláusulas suelo,….). Partiendo de la creciente casuística sobre
reclamaciones vinculadas a los productos bancarios (especialmente
presentes a partir de la crisis económica), este estudio pretende
adentrarse en la problemática asociada a los procesos colectivos de
consumo y las recientes reformas acometidas en la ley.
[eng] There is no doubt that the banking sector has been one of the most affected by legislative changes in the matter of consumption origined, in many cases, by jurisprudence that has pronounced on different items associated with the claims of banking customers (preferential participations, ground clauses, ...). Based on this increasing cases on claims about different banking products (especially, since the world economic crisis), this article pay attention on the problems associated with civil procedures about class actions on costumers claims and the recent reforms undertaken in the law about it.
