Abstract
[spa] En este trabajo nos preguntamos si en el marco del desarrollo de la justicia pública, con el advenimiento de la edad moderna existió todavía una justicia privada que se ejerciese en el seno del espacio doméstico. Ésta debía estar vinculada y solapada con la práctica de la justicia privada de los linajes, que ha sido estudiada. El papel del padre como juez, cuyo fin trascendía lo propiamente causal en búsqueda del orden moral, le permitía una práctica de la justicia doméstica como cometido moralizador. Mientras tanto su ejercicio, al ser sometido al control del poder del príncipe, fue restringido a su cooperación al bien común. E iba a ser objeto de reflexión, tal como se refleja en la obra de algunos teólogos, a saber Domingo de Soto, que analizaremos desde esta perspectiva.
[eng] In this article we talk about the existence of a domestic justice linked to the private justice of lineages; both realities are resisted a period characterised in fact by the development of prince justice, the public justice. We've interest about the father as a judge. His justice search a moral order at home but his exercise was limited to the centralisation of prince power and delimited to cooperation to common interest and in early modern history is object of reflection of several teologist as Domingo de Soto, analyzed now under this perspective.
