[spa] En el presente Trabajo de Fin de Máster (TFM) examinamos y contextualizamos el recorrido
normativo que ha experimentado el derecho de los refugiados y los derechos de las mujeres
tanto a nivel internacional como a nivel de la región europea. Todo ello para analizar la reciente
sentencia del Tribunal de Justicia de la Unión Europea C-621/21 sobre la interpretación de los
artículos de la Directiva 2011/95/UE. Este caso establece un precedente dentro de la protección
de las mujeres víctimas de violencia doméstica en el derecho de asilo de la Unión Europea al
considerar a estas mujeres como parte de un “determinado grupo social” y por lo tanto aptas
para obtener protección en base a la Convención sobre el Estatuto de los Refugiados de 1951.
Un hecho que rompe con el vacío legal y jurisprudencial que existía en lo referente a la
protección de las mujeres en el derecho de asilo, tanto a nivel internacional como regional.
Sobre todo, para aquellas víctimas de violencia doméstica, pues es una de las violencias más
ocurrentes y a la vez más invisibilizadas de todo el mundo. Bajo este nuevo paradigma, este
trabajo busca contextualizar y analizar los avances y desafíos que ha enfrentado la lucha por la
protección de las mujeres en este ámbito del derecho.
[eng] In this Master's Thesis (TFM) we examine and contextualise the regulatory path that the right to refugee and women's rights have undergone both at the international level and at the level of the European region. All this in order to analyse the recent judgment of the Court of Justice of the European Union C-621/21 on the interpretation of the articles of Directive 2011/95/EU. This case establishes a precedent in the protection of women victims of domestic violence in EU asylum law by considering these women as part of a ‘particular social group’ and therefore eligible for protection on the basis of the Convention relating to the Status of Refugees of 1951. This breaks with the legal and jurisprudential vacuum that existed regarding the protection of women in asylum law, both at international and regional level. Especially for victims of domestic violence, which is one of the most prevalent and at the same time most invisible forms of violence in the world. Under this new paradigm, this paper seeks to contextualise and analyse the advances and challenges faced by the struggle for the protection of women in this area of law.
