[spa] Las personas con discapacidad han pasado de ser las
grandes olvidadas por el legislador, tanto a nivel sustantivo como
procesal, a encabezar algunas de las principales reformas recientes del
ordenamiento jurídico español. Conscientes de la importancia que las
reformas operadas por el legislador representan para este colectivo,
dedicaremos el presente estudio a realizar una aproximación al
expediente de jurisdicción voluntaria para la adopción de las medidas
de apoyo a personas con discapacidad. El análisis de la regulación actual no solamente nos permitirá conocer los pros y contras del
procedimiento previsto, sino también la posibilidad de revisión de las
medidas adoptadas, como fórmula para adaptar el proceso a las
verdaderas necesidades de este colectivo.
[eng] People with disabilities have deeply been ignored by the legislator, both from the substantive law and procedural law, in law changes; buy recent bills of law point out some updates about its rights. Being aware of the relevant role that these new laws means for this group, this paper analyze the voluntary jurisdiction process for the judiciary measures to support people with disabilities. The analysis of the law in force will not only allow us to know the pros and cons of the planned procedure, but also the possibility of reviewing again the measures that have been adopted, as a way of adaptation to the people’s needs.
