De Barcelona a Milà. Jutges austriacistes hispànics al Senat de Milà durant el regnat de Carles VI, 1706-1740

Abstract

The dominion of Charles III, the Archduke (since 1711, Charles VI) over the states of Italy did not initially mean any change in the system of government established by the Spanish Austrias. In Milan, they corresponded to foreign magistrates, of royal appointment, three seats in the Senate (out of a total of fifteen) and two to Ordinary and Extraordinary Magistrates. The Senate of Milan was the highest body of justice and government in the state. His appointments came from Barcelona and, since 1713, from Vienna. According to the agreements reached at the General Court of Barcelona in 1705, there was a significant presence of Catalan jurists, which broke with the monopoly that the Castilian judges had had for two centuries. The article describes their trajectories and their role in the Senate, as people outside the country, and therefore supposedly without prior interests, but also as representatives and guarantors of royal authority.
