    Opening the black box of the Spanish legislative Process: The Legislative Amendments Dataset (1996-2023)

    The Spanish Legislative Amendments Dataset provides comprehensive information on all amendments proposed to all executive bills introduced to the Spanish parliament from 1996 to 2023. At the bill level, the dataset provides information on the total number of proposed amendments to each bill (a total of 117.575), the parliamentary group proposing the amendments; and the main characteristics of each bill to which amendments were proposed. These characteristics include the bill title, date of proposal, the legislative committee that debated it, the bill topic, the type of law (if the bill is passed), the number of parliamentary appearances organized along the bill’s debate, and the bill’s regional and European content.This is the first systematic dataset of legislative amendments created in Spain. It is comprehensive (not sample-based) and was developed using web scraping and text-parsing techniques. The project was made possible through funding from the Spanish Ministry and the research projects OPPOL and LEGISPRO (RTI2018-096950-A-I00 and PID2021-127542NB-I00).The dataset is a valuable resource for researchers in political science, particularly those focusing on legislative studies, parliamentary behaviour, party dynamics, and political institutions. It is also relevant for teachers, interest groups, political parties, and other stakeholders (including public administrations and consulting firms) with an interest in, or affected by, legislation passed in the Spanish parliament.

    Do the regional and European content of legislation shape party behavior in national parliaments? an analysis of the Spanish case

    Using the Spanish case, this paper explores whether the European and regional content of legislation debated in national parliaments influences parties’ legislative behaviour, and more specifically their decision to propose legislative amendments. Based on regression analysis and multilevel modelling for hypothesis testing and an original dataset including information on more than 90,000 amendments, results illustrate that parties are more likely to propose amendments on bills having regional content. This is explained because self-government between the state and regional authorities remains open to renegotiation and due to the persistent territorial cleavage. Yet, against the niche party literature, results show that both regional and statewide parties propose a significant number of amendments on bills having regional content, especially when territorial affairs are politicised. Regarding the European dimension, despite the absence of hard Eurosceptic parties in Spain and the lack of a strong political cleavage over European integration, our findings challenge the idea that in Europhile countries EU-related bills are rarely amended. Overall, while previous literature has primarily focused on governmental factors to explain parties’ decisions to propose amendments on national legislation, this paper highlights the importance of considering multi-level dynamics.

    Voices heard and unheard: Analizing legislative amendment proposals on underprivileged groups in Spain

    This paper explores the circumstances under which parliamentary groups reference underprivileged groups—specifically, women, immigrants and people with disabilities –in their legislative amendment proposals. Drawing on a comprehensive dataset covering all executive bills passed in Spain between 1996 and 2023, we find that the presence of interest groups in parliamentary hearings significantly increases the visibility of the underprivileged in the amending activity of political parties, thereby enhancing their representation. Similarly, a higher proportion of women Members of Parliament (MPs) in a parliamentary group is associated with more frequent amendments referencing women and people with disabilities, while there is some evidence, albeit less conclusive, of a similar effect for immigrants. Media coverage boosts attention to women and people with disabilities, but has no significant impact on references to immigrants. Surprisingly, partisan preferences have no influence on references to women and immigrants in amendment proposals; however, right-wing parties are more likely to reference people with disabilities. These findings contribute fresh insights into the dynamics of legislative behavior, representation, and the presence of interest groups in parliamentary processes.

    The More Favourable Provision Clause in EU Migration Law: Expanding Fundamental Rights through National Discretion?

    Interaction between different levels of fundamental rights protection is a widely debated topic in EU scholarship, which has long dealt with situations in which national legislation lowered legal standards in the EU. Less explored, however, is the opposite case: when Member State regulations set standards higher than those enshrined at EU level. This can occur through application of the more favourable provision (MFP) clause – commonly enshrined in EU directives dealing with (but not limited to) immigration and asylum. Under it, Member States can apply more favourable standards insofar as they comply with EU legislation. Though seldom discussed in existing literature, the MFP clause is a critical issue of EU migration law and illustrative of challenges facing the EU constitutional order, for it highlights the relationship between fundamental rights protection in the multi-layered EU system and general principles of EU law. Against this backdrop, this paper will investigate the features of the MFP clause in EU migration law and analyse the CJEU’s adjudication in immigration and asylum cases, exploring its reasoning in testing application of MFP clause against EU law.

    El rompecabezas de Afganistán: hacia la construcción de un Estado

    En este artículo se aborda la difícil situación afgana, caracterizada por las rivalidades étnicas, por la aparición de radicalismos religiosos y por la presencia de intereses de otros actores internacionales. Todo ello dificulta el logro del que debería ser el primer objetivo: que Afganistán llegue a ser un Estado (que verdaderamente funcione como tal). De hecho, últimamente la situación se ha deteriorado. Este análisis plantea un marco para la acción que asume que los conflictos complejos requieren de soluciones complejas. No vale aludir a vías militares, económicas, políticas o ideológicas. La solución pasa por integrar esos y otros aspectos en un escenario único, de tipo poliédrico.

    Redesigning choice to tackle school segregation: the impact of Barcelona’s desegregation policies

    The relationship between school choice and segregation remains a contentious issue in both academic and policy spheres. In recent years, the redesign of school choice policies

    has gained traction as a strategy to mitigate their negative impacts on school segregation. In this context, Barcelona (Spain) implemented desegregation policies in 2019, primarily based on redesigning specific school choice policy instruments to reduce the uneven distribution of socially disadvantaged students among schools. This study examines the impact of these policies on school segregation and explores how their effectiveness varies according to the characteristics of different areas within the city. The findings indicate that desegregation policies have reduced the uneven distribution of socially disadvantaged students and their isolation in specific schools. However, our results also show that, in each area, impacts are mediated by factors such as residential segregation, the enrolment in subsidised private schools, the share of students schooling outside their educational area, and the prevalence of siblings already attending a school, which confers priority access in admissions. We argue that the relative success of Barcelona’s school choice reform in addressing school segregation lies in its shift from a coordinated to a controlled choice model.

    ¿Clandestinas o con derechos? Los condicionantes sociopolíticos de la legislación sobre el trabajo sexual en España y Nueva Zelanda

    El objetivo de este artículo ha sido realizar un estudio comprensivo de los condicionantes que han posibilitado (o no) la construcción de una mayoría proderechos en Nueva Zelanda y en España. Se trata de un trabajo que analiza, desde una perspectiva comparada, histórica y filosófica, dos escenarios sociales y jurídicos distintos respecto al trabajo sexual, a partir de una revisión bibliográfica de distintas fuentes, en particular, artículos y libros académicos, leyes y sentencias. A lo largo de estas páginas se constatan las diferencias entre ambos contextos, así como la existencia de condicionantes sociopolíticos determinados que han posibilitado la despenalización del trabajo sexual en Nueva Zelanda. Entre ellos encontramos la evolución histórica del territorio, su tamaño, el sistema electoral y la estrategia de conformación de alianzas transversales del Colectivo de Prostitutas de Nueva Zelanda (NZPC). Tras exponer la situación en la que se encuentra España respecto a la prostitución, de la campaña del NZPC se extraen, finalmente, aprendizajes para la construcción de una mayoría descriminalizadora en el contexto español, concluyendo que en España las iniciativas proderechos deberán proceder del ámbito social.

    Is Morocco Operating a Grey Zone in Ceuta and Melilla?

    Tensions between Spain and Morocco rose throughout 2021. However, they stem from decades-long conflicts over territory. One of Rabat’s main claims relates to the Spanish cities of Ceuta and Melilla, located on the north coast of Africa. The present article highlights the main clashes between the two countries and their respective positions. It then explores whether Morocco is operating a Grey Zone strategy to secure control over the two cities in the medium term and concludes that this is indeed the case.

    Le gouvernement du changement ? L'approche de Barcelona en Comú de la gouvernance métropolitaine

    Cet article analyse l'impact de l'arrivée à la mairie de Barcelone de Barcelona en Comú (BeC), la plateforme citoyenne dirigée par l'activiste Ada Colau, par rapport à l'enjeu de la gouvernance métropolitaine. Cette plateforme a surgi comme alternative au gouvernement conservateur de Xavier Trias lors du mandat antérieur (2011-2015), qui avait lui-même mis fin à 30 années de gouvernement de gauche. Les propositions de BeC prétendent rompre avec le modèle précédent, mais elles se heurtent à des tendances lourdes (formelles et informelles) de fonctionnement institutionnel. Nous analyserons dans quelle mesure il est possible de déceler un changement par rapport aux approches de la gouvernance métropolitaine, concrètement en relation aux politiques publiques (output legitimacy) et à la représentation démocratique (input legitimacy). This article analyzes the impact of the arrival at the Barcelona City Hall of Barcelona en Comú (BeC), the citizen platform led by activist Ada Colau, in relation to the issue of metropolitan governance. This platform has emerged as an alternative to the conservative government of Xavier Trias during the previous term (2011-2015), which had itself ended 30 years of left-wing government. BeC's proposals claim to break with the previous model, but they clash with the strong (formal and informal) trends of institutional functioning. We analyze to what extent it is possible to detect a change compared to the approaches to metropolitan governance, concretely in relation to the public policies (output legitimacy) and to the democratic representation (input legitimacy).

    Lon Fuller’s theory concerning the inner morality of law can be understood not only as an expression of technical reason in law, but also as an expression of practical reason. To develop the latter conception, we must recast the formal definition of law in The Morality of Law in teleological terms by drawing on Fuller’s other works. In this reading, law can be viewed as a social practice that protects and promotes individual freedom through rules that limit and channel political power.

    Judicial independence through the lenses of EU judges: Constitutional momentum in support of European Union law and of a European Union based on the rule of law

    In the framework of the European Union, the concept of judicial independence is of particular significance, a point that is of increasing relevance. The concept is becoming more precisely defined, and it shows indicators for its assessment that are worthy of note. However, it is not yet fully formed, and is still a work in progress. It is being developed at an unprecedented pace for a very specific reason: its importance to the construction of Europe. This paper will focus on the elements that are vital in defining judicial independence. A series of questions will be raised that are key to making progress in defining the concept of judicial independence. In this paper, I will put forward my vision of judicial independence and raise specific topics and questions that I believe need to be considered fully if we are to make any progress towards achieving a robust judicial independence. First, the differences in the understanding of judicial independence on the part of the European Court of Human Rights on the one hand, and the Court of Justice of the European Union on the other are presented. Secondly, essential elements of subjective and objective judicial independence are highlighted. Thirdly, judicial independence as a judge’s right is explained. Finally, the most important elements of judicial accountability are discussed.

    La libertad de creación artística en la jurisprudencia del Tribunal Constitucional: ¿Un derecho autónomo con un régimen jurídico propio?

    El análisis de la jurisprudencia del Tribunal Constitucional en materia de libertad de creación artística muestra que se trata de una libertad cuyo reconocimiento y régimen jurídico-constitucional se está forjando en las últimas décadas. Partiendo de este contexto, se ha producido una evolución en la doctrina constitucional que ha pasado de considerarla parte de la libertad de expresión a concebirla como una libertad autónoma. Aunque esta evolución no ha sido ni lineal ni clara, en un doble y relevante sentido. Por un lado, el tránsito hacia una libertad autónoma no ha sido ni razonado ni armado con una mínima carga argumental y, a día de hoy, no queda todavía meridianamente clara la postura del Tribunal respecto del ámbito objetivo de esta libertad. Por otro lado, la autonomía de la libertad de creación artística respecto de la libertad de expresión debería abocar al diseño de un mínimo régimen jurídico-constitucional diferenciado respecto de ésta, que no se ha apuntado por parte del Tribunal. Este artículo analiza con detalle la descrita evolución de la jurisprudencia constitucional en relación con la libertad de creación artística, valorando las distintas opciones de la doctrina constitucional.

    Discurso del odio en las redes sociales: La libertad de expresión en la encrucijada

    Las reflexiones académicas sobre la jurisprudencia del Tribunal Europeo de Derechos Humanos (TEDH) relativa al discurso del odio son frecuentes. Sin embargo, actualmente se plantean relevantes interrogantes que todavía restan abiertos. Para empezar, no parece que la Corte europea tenga una concepción clara y uniforme sobre el discurso del odio, sino que bajo este paraguas se cobijan realidades distintas. Para continuar, el TEDH aplica idéntico tratamiento jurídico a estas diferentes realidades, obviando que el derecho debe ofrecer respuestas distintas a problemas distintos.Finalmente, la Corte no ha aclarado si este tratamiento jurídico del discurso del odio, que siempre ha aplicado a mensajes emitidos por los canales tradicionales de comunicación, puede trasladarse mutatis mutandi al discurso difundido a través de redes sociales. Estos tres relevantes temas constituyen el objeto del estudio que se recoge en este artículo.Concretamente, el estudio se propone dar pasos en la delimitación del concepto de discurso del odio; proponer un tratamiento jurídico distinto a los diferentes tipos de discurso del odio; y analizar qué consecuencias resultarían de aplicar la jurisprudencia europea sobre discurso del odio a la comunicación en la red.

    Sobre el concepto de libertad

    Un lugar común de la filosofía política contemporánea es la idea de que el término «libertad» no designa un solo valor o ideal sino varios y que, por tanto, no es posible formular un concepto único de libertad. Sin embargo, un examen de las relaciones que existen entre esos diversos ideales autoriza al menos a intentarlo. La libertad puede concebirse unitariamente como la capacidad para la autonomía. Las distintas libertades (la libertad negativa, la libertad positiva y la libertad como poder) serían todas ellas condiciones necesarias de esta capacidad o, en otros términos, elementos constitutivos de la libertad.

    Conflictos entre la dignidad y la libertad: una reformulación

    Este artículo analiza los conflictos entre la dignidad humana y la libertad que surgen a la hora de decidir si ciertas prácticas sociales controvertidas deberían ser permitidas o prohibidas por el derecho. El autor sugiere que estos conflictos pueden comprenderse y tratarse mejor si se replantean como una discrepancia acerca de las condiciones necesarias para garantizar la libertad no sólo de los directamente implicados en esas prácticas, sino de todos los miembros de la comunidad. Una de esas condiciones es la disposición de un amplio ámbito de no interferencia, y es la que reivindican quienes invocan la libertad. Otra de esas condiciones, igualmente importante, es la vigencia de prácticas sociales significativas y valiosas, y a ella se remiten quienes invocan la dignidad, considerando que promover tales prácticas y desalentar las que no lo son puede y debe hacerse por medios jurídicos.

    Libertà in un pianeta abitabile

    Se c'è un tema tanto ricorrente quanto conflittuale nel corso della storia del pensiero questo è la libertà umana, sia in generale che in alcune delle sue manifestazioni specifiche (libero arbitrio, libertà di pensiero, libertà religiosa, libertà di agire, ecc.). In ragione di ciò, quanto segue non ha alcuna pretesa di originalità. Né di atemporalità: un po' come cercare di definire, a partire, ad esempio, da una pomposa e magniloquente Teoria della giustizia, ciò che si debba intendere per libertà in ogni epoca e luogo. La finalità che anima queste pagine è molto più umile: con esse si intende unicamente fornire stimoli alla riflessione, su un piano più normativo che prasseologico, su ciò che si deve intendereper libertà tenendo conto dei grandi problemi che l'umanità dovrà affrontare nel corso del XXI secolo.
