Abstract: | Este trabajo tiene por objeto analizar el tratamiento contractual que reciben los convenios entre administraciones públicas territoriales en el ordenamiento jurídico español. A tal efecto se examina, en primer lugar, la posibilidad de considerar dichos convenios como contratos públicos bajo el Texto refundido de la Ley de Contratos del Sector Público; para pasar a cuestionar, seguidamente, qué consecuencias prácticas pueden derivarse de esta consideración y la conveniencia de someter estas relaciones convencionales a la normativa contractual. The purpose of this paper is to analyze the contractual procedure and treatment that interadministrative agreements receive in the Spanish legal system. In order to do so, first there is the need to consider such agreements, as instructed by the tRlcsp, as public contracts. Then the paper examines the practical consequences that can derive from this qualification and the convenience of submitting these agreements to the standard contractual regulation in the tRlcsp |
