Los medios de coerción legitimados en el ámbito penitenciario español en
virtud del articulo 45 LOGP y 72 RP son el aislamiento provisional, la fuerza física
personal, las defensas de goma, los aerosoles de acción adecuada y las esposas. Sin
embargo, mediante la Instrucción 3/2018, se habilita en el sistema penitenciario el uso
de la contención o sujeción mecánica regimental. Es objeto de este trabajo el análisis de
la legitimidad de la aplicación de la contención mecánica por motivos regimentales en
el ámbito penitenciario como medio de coerción.
The means of restrain legitimised in the Spanish penitentiary sphere by virtue of article 45 LOGP and 72 RP are provisional isolation, personal physical force, rubber defences, appropriate action sprays and handcuffs. However, by means of Instruction 3/2018, the use of regimental mechanical restraint is enabled in the Spanish prison system. The purpose of this paper is to analyse the legitimacy of the application of mechanical restraint for regimental reasons in the penitentiary environment as a means of coercion.
