[spa] Esta tesis examina la gestación por sustitución desde una perspectiva histórico-jurídica y de derecho comparado, con el fin de valorar su posible tratamiento en el ordenamiento español. El estudio parte de la insuficiencia del marco vigente para ofrecer una respuesta coherente a los problemas que esta práctica plantea en materia de filiación, consentimiento y protección del menor. La investigación se organiza en torno a tres ejes: los precedentes históricos de la sustitución reproductiva en la Antigüedad, la revisión crítica de las categorías tradicionales de maternidad y filiación, y el análisis del régimen jurídico actual en España a la luz del derecho comparado y de la jurisprudencia. A través de una metodología histórica, dogmática y comparada, el trabajo muestra que la gestación por sustitución cuestiona criterios clásicos del Derecho de familia, en especial la determinación de la maternidad a partir del parto, y que la respuesta prohibitiva del sistema español no resuelve de forma satisfactoria las situaciones ya consolidadas. La tesis concluye que el tratamiento jurídico de esta realidad exige una respuesta más sistemática y coherente, capaz de equilibrar los derechos de la mujer gestante, de los progenitores comitentes y, sobre todo, el interés superior del menor.
[cat] Aquesta tesi examina la gestació per substitució des d’una perspectiva historicojurídica i de dret comparat, amb la finalitat de valorar-ne el possible tractament en l’ordenament espanyol. L’estudi parteix de la insuficiència del marc vigent per oferir una resposta coherent als problemes que aquesta pràctica planteja en matèria de filiació, consentiment i protecció del menor. La recerca s’organitza al voltant de tres eixos: els precedents històrics de la substitució reproductiva en l’Antiguitat, la revisió crítica de les categories tradicionals de maternitat i filiació, i l’anàlisi del règim jurídic actual a Espanya a la llum del dret comparat i de la jurisprudència. Mitjançant una metodologia històrica, dogmàtica i comparada, el treball mostra que la gestació per substitució qüestiona criteris clàssics del dret de família, en especial la determinació de la maternitat a partir del part, i que la resposta prohibitiva del sistema espanyol no resol de manera satisfactòria les situacions ja consolidades. La tesi conclou que el tractament jurídic d’aquesta realitat exigeix una resposta més sistemàtica i coherent, capaç d’equilibrar els drets de la dona gestant, dels progenitors comitents i, sobretot, l’interès superior del menor.
[eng] This thesis examines surrogacy from a historical-legal and comparative law perspective in order to assess its possible treatment within the Spanish legal system. The study starts from the premise that the current framework is insufficient to provide a coherent response to the main issues raised by this practice, particularly in relation to legal parentage, consent and the protection of the child. The research is structured around three main lines of analysis: the historical background of reproductive substitution in Antiquity, a critical review of traditional concepts of motherhood and parentage, and the examination of the current Spanish legal framework in light of comparative law and case law. Using a historical, doctrinal and comparative methodology, the thesis argues that surrogacy challenges classical family law criteria, especially the determination of motherhood through childbirth, and that the current prohibition in Spain does not satisfactorily resolve already existing family situations. The thesis concludes that this phenomenon requires a more systematic and coherent legal response, capable of balancing the rights of the surrogate, the intended parents and, above all, the best interests of the child.
