Abstract

El objetivo del presente estudio es considerar los conocimientos sobre el comportamiento (behavioural insights), que han conducido al llamado Derecho conductual (behavioural law) y a los acicates (nudges), Los nudges y el diseño conductual de políticas públicas desde una perspectiva jurídica, imprescindible en su necesario análisis inter/transdisciplinario. Partiendo de esa relevancia jurídica de los acicates, se analizan cuestiones concretas referentes a su incidencia en los ciudadanos desde la perspectiva de un Estado Social y Democrático de Derecho como el español.
