Abstract
El principal problema que plantea el desarrollo del acceso abierto no son las restricciones que impone el derecho de autor sino el interés del editor de revistas comerciales en obtener beneficios por publicar artículos. El acceso abierto solo logrará implantarse plenamente si comporta un modelo de negocio que resulta atractivo al editor. Las iniciativas legislativas adoptadas para fomentar el acceso abierto en España y en otros países europeos no han resultado eficaces. Los nuevos acuerdos transformativos entre universidades y editoriales de revistas científicas introducen un nuevo modelo de negocio para los editores que puede acelerar el desarrollo del acceso abierto en todo el mundo, si satisface los intereses de todas las partes implicadas en el acceso abierto.
Copyright restrictions are not the main barrier to develop open access to scientific publishing. It is the commercial interest of publishers in making profit from their journals, what prevents the rapid transition towards open access. Commercial publishers will only provide full open access journals if they generate revenues for them. The law provisions adopted in Spain and other European countries to foster open access to scientific publishing did not increase their share of open access publications. The new transformative agreements between universities and publishers introduce a new business model for publishers that may enhance the path to open access worldwide, if they also satisfy the interests of all stakeholders.
