Bioetica y discapacidad: de como la Declaración UNiversal sobre Bioética y Derechos Humanos de UNESCO puede y debe constituirse un referente para su tratamiento

El trabajo analiza la Declaración Universal sobre Bioética y Derechos Humanos de UNESCO de 2005, a la luz de la Convención sobre Derechos de las Personas con Discapacidad de Naciones Unidas de 2006, con el objeto de identificar las aportaciones de UNESCO al trabajo de los Estados en el diseño y desarrollo de políticas, programas y acciones que favorezcan la efectiva inclusión social de las personas con discapacidad asegurando el goce pleno y en condiciones de igualdad de sus derechos y libertades fundamentales. Se destaca en este sentido el principio de responsabilidad social enunciado por UNESCO en su Declaración, en tanto, promueve un nuevo enfoque hacia la justicia social para el tratamiento de las cuestiones bioéticas en torno a la discapacidad. Asimismo, este trabajo incorpora una referencia al marco normativo que en la materia han adoptado el sistema interamericano y europeo, agregando en este último ámbito una mención al caso español.
The paper analyzes the Universal Declaration on Bioethics and Human Rights, (UNESCO, 2005) in light of the Convention on Rights of Persons with Disabilities (United Nations, 2006). The goal is to identify the contributions of UNESCO’s to the States contributions related to design and development of policies, agendas and actions promoting effective social inclusion of people with disabilities, by ensuring the full and equal enjoyment of their fundamental rights and freedoms. The paper highlights the principle of social responsibility built up by UNESCO in its Declaration, promoting a new approach to social justice when addressing bioethical issues in disabilities. Furthermore, an overview of the current regulatory framework in European and inter– American system is provided, including a specific reference to the Spanish situation.
