El sistema de Alternative Dispute Resolution en el ámbito de consumo, es un tema actual que la Unión Europea busca impulsar en su territorio para garantizar una libre concurrencia en su mercado interno. El trabajo hace un análisis de la normativa más reciente del parlamento europeo en ese campo (Directiva 2013/11/UE) en conjunto con su transposición por la Ley española 7/2017, enfocando los procedimientos de
mediación. El estudio consiste en una breve presentación de las nuevas Entidades de Resolución Alternativa de conflictos y de su forma y reglas de funcionamiento. El principal enfoque de desarrollo son las normativas sobre obligatoriedades impuestas, por la Ley 7/2017, a los comerciantes/empresas y a los consumidores. Los análisis confrontan el actual texto legal con las reglas ya existentes en el ordenamiento jurídico español y europeo, presentando temáticas recientes e interpretaciones críticas sobre las ADR de mediación en consumo.
The Alternative Dispute Resolution, inside the consumption area, is a current topic inside the European Union, which it seeks to boost in order to improve the free competition in its internal market. The present work analyzes the newest normative of the European Parliament in this field and its transposition to the Spanish Law 7/2017. This work briefly presents the current Conflict Resolution Entities and its forms and rules of operation. The main subjects of analysis in this study are the normatives about the mandatory adherence imposed by the Spanish Law to the companies and consumers. The analysis confronts the most recent legal text against the rules that already exist in the Spanish and European Legal Order, showing topics and critical interpretation about the ADR of consume in the mediation field.
