[cat] Aquesta recerca presenta una revisió historiogràfica de l’emfiteusi a Catalunya des del segle XII fins al XIX, abordant-la no com una institució jurídica estàtica, sinó com una pràctica fonamental en l'evolució socioeconòmica del territori. L'estudi ressegueix els orígens de l'establiment emfitèutic en l'entramat feudal, passant pels mecanismes de legitimació després de la Sentència Arbitral de Guadalupe, així com l'adaptabilitat del contracte a nous contextos, prenent subjectes i formes diverses. Usant com a base la historiografia de referència en la qüestió, es pretén mostrar que l'emfiteusi ha estat una eina de modelat el paisatge, les relacions de producció i l'estructura de la propietat a Catalunya.
[eng] This research presents a historiographical review of the emphyteutical practice in Catalonia, between the 12th and 19th centuries, apporaching it not as a static legal institution but as a fundamental practice in the socio-economic evolution of the territory. The study traces the origins of the emphyteutic tenure within the feudal framework, examining it’s mechanisms of legitimation following the Sentencia Arbitral de Guadalupe, as well as the contract’s adaptability to new contexts, taking on diverse forms and actors. Drawing from key historiographical Works on the subject, this research aims to demonstrate that emphyteusis functioned as a landscape-shaping tool, as well as molding relations of production and the structure of property in rural Catalonia.
