Abstract
[spa] La Directiva 2014/17 regula los contratos de créditos sobre bienes inmuebles con consumidores. Parte de la regulación tiene que ver con la conducta y la supervisión de los prestamistas y otra parte son normas específicas de protección al consumidor, en materia de transparencia en la publicidad y en la información precontractual, advertencias, consejos, y análisis de la solvencia; y aun otras se refieren a la educación financiera. La norma no convulsionará el sistema: servirá para consolidar lo que hasta la fecha ya eran prácticas habituales y quizás propiciará la armonización de normas prudenciales del sistema bancario y financiero en Europa. En particular, permitirá a las autoridades bancarias europeas controlar qué nuevas medidas se están adoptando con el fin de evitar que los deudores queden privados de sus viviendas.
[eng] Directive 2014/17 regulates consumer credit agreements relating to the immovable property. Part of the rules have to do with supervision of le nders and other specific rules deal with consumer protection in topics, such as transparency in advertising and pre-contractual information disclosure, warnings, advice, and consumer’s creditworthiness assessment. The Directive will not provoke a revolution, but will consolidate usual practices and, perhaps, will promote the harmonization of banking prudential norms in Europe. In particular, the Directive will enable European banking authorities to monitor the measures that are being taken in order to prevent debtors from being evictioned of their homes.
