[spa] La Justicia Restaurativa es una forma de justicia orientada a la restauración de los efectos del delito mediante la participación de los implicados en el mismo. Este estudio tiene como objetivos conocer los factores que dificultan y favorecen el uso de la justicia restaurativa en delitos violentos y comprender qué potencial socioeducativo tiene respecto a las partes implicadas. En el marco teórico, se define el marco conceptual de la justicia restaurativa, se expone su aplicación a la conducta criminal violenta, y se ahonda en su potencial socioeducativo respecto a víctimas y victimarios. El trabajo de campo exploratorio recoge, con un muestro intencional, las voces de diferentes profesionales del campo de la justicia penal en Cataluña mediante una metodología cualitativa, complementada y contrastada con los resultados de un cuestionario dirigido a la población general. Los resultados permiten corroborar el valor de la justicia restaurativa aplicada a los delitos violentos, identificando algunas oportunidades para ampliar su aplicación.
[eng] Restorative Justice is a form of justice aimed at restoring the effects of crime through the participation of those involved in it. This study aims to find out the factors that hinder and favor the use of restorative justice in violent crimes and understand what socio-educational potential it has with respect to the parties involved. In the theoretical framework, the conceptual framework of restorative justice is defined, its application to violent criminal behavior is exposed, and its socio-educational potential regarding victims and perpetrators is delved into. The exploratory fieldwork collects, with an intentional sampling, the voices of different professionals in the field of criminal justice in Catalonia through a qualitative methodology, complemented and contrasted with the results of a questionnaire aimed at the general population. The results allow corroborating the value of restorative justice applied to violent crimes, identifying some opportunities to expand its application.
