El precedente judicial. La previsibilidad de la sentencia y la decisión automatizada del conflicto

Abstract

En este trabajo se analiza la premisa para implantar mecanismos de decisión automatizada de la justicia que es la previsibilidad de las resoluciones que se van a adoptar. Para ello se desarrolla el precedente judicial y la vinculación del órgano jurisdiccional las sentencias dictadas por los tribunales superiores y por ellos mismos. Finalmente se desarrolla el fracaso de la función nomofilática de los tribunales superiores por la existencia de un ordenamiento jurídico multinivel y el intento de superación de estas dificultades con la regulación de los procedimientos testigo. This paper analyzes the premise to implement automated decision-making mechanisms of justice, which is the predictability of the resolutions to be adopted. For this, the judicial precedent and the binding of the jurisdictional body to the sentences handed down by the higher courts and by themselves are developed. Finally, the failure of the nomophilic function of the superior courts is developed due to the existence of a multilevel legal system and the attempt to overcome these difficulties with the regulation of witness procedures.
