[spa] La reforma canónica de los procesos matrimoniales promulgada por el papa Francisco en el motu proprio Mitis Iudex Dominus Iesus, de 15 de agosto de 2015, tiene por objeto facilitar los trámites para obtener sentencia, e incide así en la celeridad del proceso. No ha cambiado las causas substantivas de nulidad de matrimonio. El artículo estudia desde un punto de vista práctico qué incidencia puede tener la nueva normativa en los procesos matrimoniales eclesiásticos, cómo aplicarla y qué aspectos deberán ser concretados por los Tribunales de la Iglesia. También aporta elementos críticos para una futura mejora de esta legislación.
[eng] The canonical matrimonial proceedings reform promulgated by Pope Francis in the motu proprio Mitis Iudex Dominus Iesus, of 15 August 2015, aims to facilitate the procedures for judgment, and thus affects the speed of the process. It has not changed the substantive grounds for annulment of marriage. This article examines from a practical point of view what impact may have the new legislation in matrimonial proceedings, how to apply it, and what aspects should be concretized by the courts of the Church. It also provides critical elements for further improvement of this legislation.
