[cat] Els supòsits on els progenitors es demanden per incompliment del règim de visites o de l'exercici de la custòdia no són nous. Però el cas objecte de comentari és el primer en què el Tribunal Suprem imposa una obligació de compensar pel dany moral causat quan un progenitor, després de traslladar unilateralment al fill a un país estranger, impedeix a l'altre tota relació personal amb el fill, incomplint el règim de custòdia reconegut per una resolució judicial dictada a Espanya. Aquest treball analitza la problemàtica jurídica que planteja la substracció de menors, tot presentant les seves conseqüències indemnitzatòries.
[eng] Cases where one parent sues the other due to a breach 01 the custodial regime are not neto, but the case in study does present a new approach as regards tort law. It is the /irst time the Spanish Supreme Court has established that one parent has a duty to compensate the other for damages caused when taking the child abroad without the other's consent, and then preventing any contact between parent and child. The abduction prevents one parent from carrying out the custodial duties established by a Spanish judicial ruling. This paper presents the legal issues derived from a minor's abduction and the possible consequences as regards tort law.
