L'eficàcia dels actes jurídics realitzats sense assistència en el dret civil català

Abstract

L’aprovació de la Convenció Internacional sobre els Drets de les Persones amb Discapacitat, a Nova York, en l’any 2006, va marcar un punt d’inflexió en la concepció jurídica de la capacitat, en introduir un model basat en el respecte a l’autonomia, la voluntat i les preferències de la persona. En l’àmbit del dret civil català, aquest canvi s’ha concretat amb el Decret llei 19/2021, de 31 d’agost, que adapta el Codi civil de Catalunya a un sistema de suports orientat a facilitar l’exercici ple de la capacitat jurídica, en coherència amb la reforma estatal operada per la Llei 8/2021. Aquest Treball de Fi de Grau analitza el règim d’ineficàcia dels actes jurídics realitzats per persones amb discapacitat, amb especial atenció als actes realitzats sense suport necessari. L’estudi adopta una perspectiva evolutiva. En primer lloc, s’examina el règim anterior a la reforma, previst a l’antic article 226-3 del Codi civil de Catalunya, que establia un règim d’anul·labilitat vinculat a la manca d’intervenció de l’assistent. En segon lloc, s’analitza el règim vigent, articulat a través de l’article 226-5 CCCat, que configura la impugnació com una salvaguarda excepcional i reforça el respecte a l’autonomia personal. Finalment, el treball incorpora un breu estudi del Projecte de llei de modificació del Codi civil de Catalunya en matèria de suports, actualment en tramitació parlamentària, amb especial atenció a l’article 222-62 i a les esmenes parlamentàries formulades que l’afecten, amb la finalitat d’anticipar l’orientació futura del règim d’ineficàcia dels actes jurídics.

The United Nations Convention on the Rights of Persons with Disabilities, adopted in New York in 2006, introduced a profound paradigm shift in the conception of legal capacity, based on respect for the autonomy, will and preferences of the individual. In the field of Catalan civil law, this shift materialised through Decree Law 19/2021 of 31 August, which adapts the Civil Code of Catalonia to a system of supports aimed at facilitating the full exercise of legal capacity, in line with the State reform introduced by Law 8/2021. This Final Degree Project analyses the legal regime governing the ineffectiveness of legal acts carried out by persons with disabilities, with particular attention to acts performed without support. The study adopts an evolutionary approach. First, it examines the legal framework prior to the reform, as regulated in the former Article 226-3 of the Civil Code of Catalonia, which established a regime of voidability linked to the lack of intervention of the assistant. Secondly, it analyses the current regime, structured around Article 226-5 of the Civil Code of Catalonia, which configures the challenge of legal acts as an exceptional safeguard and strengthens respect for personal autonomy. Finally, the study incorporates an analysis of the Bill to amend the Civil Code of Catalonia regarding supports for the exercise of legal capacity, currently under parliamentary consideration, with particular attention to Article 222-62 and the parliamentary amendments affecting it, in order to anticipate the future orientation of the regime governing the ineffectiveness of legal acts.
