Les Assemblees de Pau i Treva. L’origen del pactisme català

Abstract

[cat] Aquest treball analitza les Assemblees de Pau i Treva i el seu possible paper dins el procés de formació del pactisme català medieval. A partir de l’estudi del context històric dels segles XI i XII i de les diferents interpretacions historiogràfiques, s’examinen les principals línies d’anàlisi sobre el significat polític, social i jurídic d’aquestes assemblees. L’estudi posa una especial atenció en la relació entre els mecanismes de regulació de la violència, el desenvolupament de pràctiques basades en el jurament, el consens i l’acord col·lectiu, i la seva possible evolució cap a formes posteriors de limitació i regulació del poder. En aquest sentit, l’estudi permet reflexionar sobre el procés històric que, des de les Assemblees de Pau i Treva, condueix progressivament a la consolidació d’institucions representatives com les Corts de Catalunya i la Diputació del General (Generalitat).

[eng] This paper examines the Peace and Truce Assemblies and their possible role in the formation of medieval Catalan pactism. Drawing upon the historical context of the eleventh and twelfth centuries, as well as different historiographical interpretations, it explores the principal lines of analysis concerning the political, social and legal significance of these assemblies. Particular attention is devoted to the relationship between mechanisms for the regulation of violence, the development of practices based on oath-taking, consensus and collective agreement, and their possible evolution into later forms of limitation and regulation of power. In this regard, the study invites reflection on the historical process through which the Peace and Truce Assemblies progressively contributed to the consolidation of representative institutions such as the Catalan Courts and the Deputation of the General (Generalitat).
