La pérdida de uno o de ambos progenitores causa una situación de desarraigo y posible necesidad que no puede obviarse desde ningún ángulo. El Derecho del Trabajo y la Seguridad social presta especial atención a la protección del huérfano, menor o no de edad. El régimen jurídico de la protección social del huérfano a través de la pensión de orfandad ha sido objeto de múltiples reformas desde su aparición pero, incluyendo la causada en 2011, no parece que esta protección siga el devenir de los tiempos.

The Labour and Social security pays special attention, to the protection of orphans, minors or adults. The legal framework for social orphan’s protection through orphan’s pension has undergone many alterations since its inception but, including those causes in 2011, this protection does not seem to follow the evolucion of time.
