La preeminencia del testimonio escrito en la Cataluña altomedieval parece haber supuesto la casi desaparición de los rituales basados en la oralidad y el gesto, en contraposición a lo que sucede en otros territorios europeos. Este estudio rastrea en la documentación latina de la Cataluña altomedieval para obtener información sobre gestos simbólicos y rituales jurídicos relacionados con la transferencia y la posesión de bienes. Así, en relación a la transferencia de bienes se atestigua la realización de los rituales de la traditio per cartam y la traditio rerum, así como el gesto de anudarse una cuerda al cuello; y, en cuanto a la toma de posesión de bienes se ofrecen algunos ejemplos que difieren en función de si se trata de tierras o de edificios.
The pre-eminence of written testimony in early medieval Catalonia seems to have led to the almost total disappearance of rituals based on orality and gesture, as opposed to what was usual in other European regions. This paper explores the existing Latin documentary evidence from early medieval Catalonia for information on symbolic gestures and legal rituals in relation to the transfer and possession of property. Thus, in relation to the transfer of goods, the performance of the rituals traditio per cartam and traditio rerum are attested, as well as the gesture of knotting a rope around the neck. Furthermore, when it comes to taking possession of the property, the paper presents some examples that differ depending on whether they refer to the ownership of land or buildings.
