[spa] El Tribunal Supremo se enfrenta una vez más a la interpretación del artículo 13 d) del Real Decreto 1006/1985 de 26 de junio que regula la Relación Laboral Especial de los deportistas profesionales. En este caso se trata de determinar si, pese a que la declaración de incapacidad permanente del deportista profesional es otorgada fuera de la vigencia del contrato de trabajo, opera o no la indemnización especial prevista en dicho artículo para el caso de lesión invalidante acaecida durante el ejercicio del deporte profesional cuando dicha incapacidad opera como causa de extinción de la relación laboral.
[eng] The High Court once again facing the interpretation of article 13 d) RD 1006/1985 of 26 June regulates the special employment relationship of professional sportsman. In this case is whether, despite the declaration of permanent incapacity of the professional athlete is given outside the contract of work, operates or not the special allowance under that provision for the case of disabling injury occurred during the exercise of professional sports where such failure operate to cause termination of employment.
