El artículo 6.3 del Reglamento (UE) 2022/2065 de Servicios Digitales (Digital
Services Act, DSA) constituye una de las disposiciones más singulares del nuevo marco europeo de regulación de plataformas. Aunque formalmente se integra en el régimen de exención de responsabilidad de los prestadores de servicios intermediarios, la norma responde a una preocupación más amplia: evitar que la configuración de una plataforma induzca al consumidor a creer que esta actúa como proveedor de los bienes o servicios ofrecidos por terceros. El presente trabajo analiza el significado de la citada disposición desde la perspectiva de la apariencia jurídica y de la confianza del consumidor, examinando diversos modelos de plataforma para ilustrar los problemas que suscita la delimitación de responsabilidades en la contratación digital.
Article 6(3) of Regulation (EU) 2022/2065 on Digital Services (Digital Services Act, DSA) is one of the most distinctive provisions of the new European framework governing online platforms. Although formally embedded within the liability exemption regime applicable to intermediary service providers, the provision addresses a broader concern: preventing the design and operation of a platform from leading consumers to believe that the platform itself is the supplier of goods or services offered by third parties. This paper examines the significance of Article 6(3) from the perspective of legal appearance and consumer reliance, using different platform models to illustrate the challenges involved in allocating responsibility in digital contracting.
