Unfair terms in b2b data contracts – issues and lessons from article 13 of the data act(Universitat de Barcelona, 2026) Riis, NineThe paper analyses Article 13 of the Data Act with the aim of identifying guidelines for the form of future EU legislation. The analysis shows that Article 13 exhibits two regulatory novelties, which give rise to two issues. With an outset in these issues, the paper derives three guidelines for future EU legislation. The guidelines consist of (i) exploring the potential of national law to address the issues the potential EU legislation wishes to target, (ii) favouring minimum harmonisation over full harmonisation, and (iii) ensuring legislative provisions with a clear scope.Document de treball
Experimental insights on consumer data sharing behaviour(Universitat de Barcelona, 2026) Weber, FranziskaIn the online world we regularly pay with our data. Yet, it is not readily understood how much we value certain data types and in which contexts. Are we able to determine the value of our data like we do for money? Only if we know individual valuations, can fitting policies be formulated. In the quest of tailoring legal reforms to the individuals’ needs, many questions still need answering. For instance, people may not mind that certain data of theirs is shared in some situations, whilst in other situations and for other types of data they do. There is a certain element of reciprocity present with direct sharing of others’ data that deserves our attention in the sense that one may be ready to accept some data sharing if those sharing would likewise tolerate this. However, in which contexts would this be the case? A fruitful path to provide some of these answers is experimental research, where ideally in an incentivised setting – that means that participants are paid depending on the choices made during the experiment and, therefore, show true behaviour – individual behaviour is tested and observed. There is a lot of research seeking to identify individuals’ valuations for data and privacy. Experimental findings show how the perception of harm varies with a view to different types of data. But also who receives the data, for instance, makes a difference. Context matters as a data leak might lead to harm in some situations but not in others.Document de treball
La apariencia en contratos con plataformas digitales(Universitat de Barcelona, 2026) Legerén Molina, Antonio[cas] El artículo 6.3 del Reglamento (UE) 2022/2065 de Servicios Digitales (Digital Services Act, DSA) constituye una de las disposiciones más singulares del nuevo marco europeo de regulación de plataformas. Aunque formalmente se integra en el régimen de exención de responsabilidad de los prestadores de servicios intermediarios, la norma responde a una preocupación más amplia: evitar que la configuración de una plataforma induzca al consumidor a creer que esta actúa como proveedor de los bienes o servicios ofrecidos por terceros. El presente trabajo analiza el significado de la citada disposición desde la perspectiva de la apariencia jurídica y de la confianza del consumidor, examinando diversos modelos de plataforma para ilustrar los problemas que suscita la delimitación de responsabilidades en la contratación digital.Document de treball
L’adaptació del dret de família (títol III, llibre segon CCCAT) i del dret de successions (llibre quart CCCAT) al nou model d’exercici de la capacitat jurídica (títols I i II, llibre segon CCCAT)(Àrea d’Estudis i Formació de l’Administració de Justícia (CEJFE), 2025) Arnau Raventós, Lídia; Ginebra Molins, M. Esperança; Tarabal, JaumeAquest treball se centra en les implicacions en el Dret de família i en el Dret de successions del procés de reforma del Codi civil de Catalunya en matèria de suports a l’exercici de la capacitat jurídica de les persones. Es comparen i s’analitzen les diferents propostes que s’han succeït fins al Projecte de llei publicat al BOPC de 13-novembre-2024. Es constata una purga terminològica que era necessària i és coherent amb els postulats inspiradors de la reforma i que afecta expressions com ara “incapaç”, “incapacitat” o “capacitat modificada judicialment”. Així mateix, es reformulen els preceptes del codi que al·ludeixen, directament o indirecta, a un determinat estàndard de capacitat. En el Projecte de llei prenen protagonisme noves categories, com ara l’actuació de la persona “per si mateixa” i “per mitjà” o “amb la intervenció” de suports. El treball estudia les solucions adoptades i en qüestiona, si escau, la coherència.
