La declaración de la víctima en delitos de violencia de género constituye, en
numerosos supuestos, el principal medio de prueba frente a la ausencia de testigos directos u otros elementos probatorios. Esta circunstancia ha otorgado especial relevancia a la valoración judicial de la credibilidad del testimonio, especialmente mediante los criterios jurisprudenciales establecidos por el Tribunal Supremo: ausencia de incredibilidad subjetiva, verosimilitud del testimonio y persistencia en la incriminación. El presente trabajo analiza la aplicación de dichos criterios mediante el estudio de diez resoluciones del Tribunal Supremo en materia de violencia de género, prestando especial atención al valor de la declaración de la víctima dentro del proceso penal y su influencia en la construcción de la convicción judicial. El análisis realizado permite observar una aplicación reiterada de los criterios tradicionales de credibilidad, aunque con adaptaciones a las particularidades contextuales de la violencia de género.
The victim’s testimony in cases of gender-based violence often constitutes the primary source of evidence in the absence of direct witnesses or other corroborating evidence. This circumstance has given particular importance to the judicial assessment of the credibility of the testimony, especially through the case-law criteria established by the Spanish Supreme Court: the absence of subjective incredibility, persistence in incrimination and plausibility of the testimony. This study examines the application of these criteria through the analysis of ten judgments delivered by the Spanish Supreme Court concerning gender-based violence. Particular attention is paid to the evidentiary value of the victim’s testimony within criminal proceedings and its influence on the formation of judicial conviction. The analysis reveals a consistent application of the traditional criteria for assessing testimonial credibility with adaptations to the specific contextual characteristics of gender-based violence.
