El "deeepfake" en los documentos audiovisuales: un reto para la valoración de la prueba.

La inteligencia artificial está revolucionando el sector de los documentos audiovisuales a través de la creación de herramientas que permiten crear fotografías y vídeos en los que lo que se plasma nunca ha sucedido. Son los denominados deepfakes. Si bien la posibilidad de manipulación de un documento siempre ha existido, el problema radica en que, con las herramientas de inteligencia artificial actuales, descubrir esa alteración es de muy difícil o imposible apreciación. Es por ello que el presente trabajo pretende abordar, en primer lugar, cómo debe ponerse de manifiesto en un proceso judicial que un documento audiovisual puede no reflejar la realidad y haber sido creado a través de herramientas de inteligencia artificial. Para ello será necesario determinar si existen pericias para identificar un deepfake, quién debe realizarlas y cómo deben ser llevadas a cabo. En segundo lugar, será preciso analizar cómo debe valorar el órgano jurisdiccional ese informe pericial.
Artificial intelligence is revolutionizing the audiovisual documents sector through the creation of tools that allow the creation of photographs and videos in which what is depicted has never happened. These are called deepfakes. Although the possibility of manipulating a document has always existed, the problem is that, with today’s artificial intelligence tools, it is very difficult or impossible to discover this alteration. That is why this paper aims to address, first of all, how it should be shown in a judicial process that an audiovisual document may have been created through artificial intelligence tools. To do this, obviously, it will be necessary to determine whether there are expert opinions to identify a deepfake, who should perform them and how they should be carried out. Secondly, it will be necessary to determine how the court should evaluate this expert report.
