La modificació de la capacitat per acceptar l'herència al Codi civil de Catalunya arran de la nova legislació sobre suport a les persones amb discapacitat

Abstract

The “Draft law amending the Civil Code of Catalonia in the matter of support for the exercise of the legal capacity of people”, which was submitted to public information in April 2023, aims to modify art. 461-9 CCCat, referring to the capacityto accept and repudiate the inheritance. The objective pursued by the work is to highlight that the new wording proposed for this precept represents a step back regarding what is provided for in the legislation currently in force regarding the capacity to accept the inheritance. In this sense, it may end up restricting the capacity that can be understood as having today, in this area,minors. Apart from this, the new wording does not directly contemplate the capacity to accept of emancipated minors, nor that the adult can have constituted support.

L’“Avantprojecte de llei de modificació del Codi civil de Catalunya en matèria de suports a l’exercici de la capacitat jurídica de les persones”, que fou sotmès a informació pública a l’abril de 2023, pretén modificar l’art. 461-9 CCCat, referit a la capacitat per a acceptar i repudiar l’herència. L’objectiu que persegueix el treball és posar en relleu que la nova redacció proposada per a aquest precepte suposa un retrocés respecte del que preveu la legislació actualment vigent quant a la capacitat per acceptar l’herència. En aquest sentit, pot acabar restringint la capacitat que es pot entendre que tenen avui, en aquest àmbit, les persones menors d’edat. Al marge d’això, la nova redacció no contempla directament la capacitat per acceptar de les persones menors emancipades, ni que la persona major d’edat pugui tenir suports constituïts.
