Abstract
La aparición del «common good constitutionalism» (constitucionalismo del bien
común) de manos de Adrian Vermeule ha generado tanto apoyos como críticas a
esta nueva teoría, determinada por su tenacidad en reemplazar al originalismo
como el summum del pensamiento jurídico conservador americano. Esto ha
despertado un interés por investigar qué conexiones teóricas puede haber entre el
common good constitutionalism y las corrientes continentales contenidas en el
término «neoconstitucionalismo». Este trabajo pasa revista de las principales
premisas tanto del neoconstitucionalismo, en sus versiones principialista y
garantista, como de las nociones básicas del common good constitutionalism, con
el objeto de comparar conceptualmente ambas teorías. El punto de encuentro que
se obtiene de esta comparación es una similitud estructural entre el common good
constitutionalism y el principialismo, si bien con importantes diferencias en su
contenido teórico; lo cual señala una tendencia global hacia corrientes
iusnaturalistas en la filosofía del derecho.
The emergence of Adrian Vermeule's concept of «common good constitutionalism» has generated both support and criticism, presenting a new perspective that aims to replace originalism as the dominant ideology within American conservative legal thinking. This development has sparked an interest in exploring the theoretical connections between common good constitutionalism and the continental theories contained in the term «neoconstitutionalism». This paper aims to examine the fundamental principles of neoconstitutionalism, encompassing both its principlist and guaranteeist variations, and the core tenets of common good constitutionalism, in order to compare the key concepts of these two theories. The analysis reveals a structural similarity between common good constitutionalism and principlism, although significant disparities exist in their theoretical content; ultimately highlighting a growing inclination towards iusnaturalism within the philosophy of law on a global scale.
