The influence of international law in a new international order
    (Routledge, 2024-09) Planas Gifra, Laura
This chapter seeks to find a correlation between the changes that the international order is undergoing and changes on the use -or disuse- of the international legal system. The main argument is that international law gained ground with the prevalence of a rules based order. Multilateralism was the grounds for finding solution to global problems, and international norms were designed with the goals to finding common grounds to solving international issues and maintaining peace and security. While this has not changed, and international norms are still an important part of how states relate with one another, today states seem to find it harder to agree on new instruments, and they do not want to be bound by new international obligations. As a result, states are turning to national law to resolve common international threats, or at least this has been the case with migration. The goal of the present chapter is to explore these changes between the development of the international legal system and the changes within the international order. In particular, these pages will set forth this parallelism in the field of security, providing a new vision of states deal with new security threats today.

Zero Chemical Pollution: A real new impetus for change?
    (Routledge, 2025-07-30) Campins Eritja, Mar
The chapter analyses the legal implications of the Zero Pollution Initiative, which builds on the myriad of legislative measures currently being worked on by the European Commission. It remains to be seen to what extent it represents a new impetus for change, beyond the merely revision of existing European Union (EU) law, and whether it is effectively the culmination of the EU’s new climate ambition. Due to the broad scope of the Zero Pollution initiative, the research focuses on the regulation of chemicals, an area of a particular complexity. In this context, the deployment of the Zero Pollution also has a clear external dimension. The EU is highly dependent on raw materials and products originating outside its borders. It is also an exporter of chemicals and waste to third countries. The impact on third countries is, on the one hand, a direct reflection of the EU’s internal policies, be they environmental but also trade, agriculture or industry policies. On the other hand, the EU sometimes seeks this external impact to reduce the scale of its global ecological footprint by promoting compliance with international commitments or by encouraging the adoption of new multilateral measures.

    Introductory remarks and conceptual framework
(Routledge, 2025-07-30) Fernández Pons, Xavier; Campins Eritja, Mar
This chapter provides a brief introduction to the object and structure as well as the conceptual framework of the book. First, it develops the broad presentation of the European Green Deal (EGD) as an ongoing strategy to be developed into multiple policy and legal instruments. Second, it addresses the issue of the European Union’s competences in the EGD’s external dimension. Lastly, it introduces the book’s broad conception of external action and conditionality, which in the case of the EGD has extraterritorial reach owing to its global intent.

Farm to Fork: Strengths and Weaknesses of a European Strategy for a Global Transition towards Fair, Healthy and Sustainable Food Systems
    (Routledge, 2025-07-30) Pons Ràfols, Xavier
European Union (EU) law on food products provides a consolidated and efficient framework for ensuring food that is safe, plentiful, nutritious and of high quality. However, on the one hand, food systems - including European ones - remain one of the main agents of climate change and of environmental degradation; and on the other hand, the COVID-19 pandemic has highlighted the need for resilient food systems that ensure access to affordable and sufficient food on a global scale. The EU’s Farm to Fork Strategy aims to contribute to the global transition towards fair, healthy, and sustainable food systems and is also a component of the of the European Green Deal (EGD) and of the European agenda to achieve the Sustainable Development Goals (SDGs). This chapter will examine the development of this strategy in its international dimension since it may have an extraterritorial character by requiring certain sustainable and healthy requirements for products of animal, forestry or plant origin from third countries if they want to enter the European market. This chapter therefore will deal specifically with the analysis of the scope and content, in legal terms, of the farm to fork strategy in its international dimension.

Joint analysis of cross-cutting issues and final considerations
(Routledge, 2025-07-30) Fernández Pons, Xavier; Fajardo del Castillo, Teresa; Campins Eritja, Mar
This chapter concludes the book with a cross-cutting analysis, briefly highlighting the weaknesses of the current global environmental protection systems and focusing on how the European Union (EU) has sought to strengthen the international impact of its regulatory power within the framework provided by the European Green Deal (EGD). The chapter evaluates the degree of ambition of the main EGD initiatives with external dimensions analysed throughout the book and also notes their limitations. It ends with some reflections on the need to promote a multilaterally agreed Global Green Deal.

Conditioning access to the European Union market on carbon footprint: the Carbon Border Adjustment Mechanism
    (Routledge, 2025-07-30) Fernández Pons, Xavier
The European Union (EU) is using different trade instruments to promote global decarbonization, including unilateral measures to condition the access to the EU’s market of certain products originating from third countries depending on their carbon footprint. This chapter is devoted to the recently adopted Carbon Border Adjustment Mechanism (CBAM), aimed at reducing the risk of the so-called carbon leakage. The logic of this measure is that EU importers of certain products originating in third countries (such as steel, aluminium, cement…) will have to acquire public certificates (CBAM certificates) for carbon emissions embedded in imported goods, based on the real emissions released during the production process in the country of origin. The EU CBAM is very original, because to date no country has implemented a big measure of this kind. But the EU CBAM is also very controversial, as certain countries (mainly emerging economies) question whether it can be compatible with the multilateral trading system and with some global rules on climate change, such as the principle of common but differentiated responsibilities. This chapter will therefore delve into the currently heated debate on the legal compatibility of the EU CBAM with these international regimes, observing also its systemic implications.

International strategic litigation for the protection of climate before the European Court of Human Rights
(Tirant lo Blanch, 2025-02-11) Saura Estapà, Jaume
In a relatively short period of time, the European Court of Human Rights (ECtHR) has been seized of a number of lawsuits which, broadly speaking, allege violations of the European Convention due to presumed breaches by various States Partics of their obligations to mitigate the greenhouse gases that cause climate change.

Access to environmental information in Latin America: the Inter-American Court of Human Rights to the rescue
(Cambridge Scholars Publishing, 2018-10-08) Médici Colombo, Gastón, 1989-
The Principle 10 of the 1992 Rio Declaration presents democracy as the best way to carry out decision-making processes in environmental matters, inviting states to implement the so-called participatory rights: access to information, participation and justice. Since then, this triad of rights occupies a key place in the sustainable development paradigm and, as such, it was considered in all the main documents related to this concept. The 2030 Agenda for Sustainable Development and its Sustainable Development Goals (SDGs) are not the exception.

The European Green Deal and the Energy Charter Treaty: Chronicle of a Breakup Foretold?
(Routledge, 2024) Médici Colombo, Gastón, 1989-
This chapter analyses a subtle (and even unintended) but significant “beyond-EU” impact of the European Green Deal (EGD) adoption: the “breakup” of the most controversial treaty on energy investment, the Energy Charter Treaty (ECT). In particular, the chapter —through the study of relevant European Union (EU) and EU Member States’ documents, case law and doctrine — depicts the (most than probable) exodus of the EU and its Member States from the ECT as a result of the EGD’s commitment to more ambitious climate action. While the chapter does not intend to provide a strict cause-and-effect analysis, the contention is that the announced mass withdrawal can be understood, at least to an important extent, as a response to the tensions arising from the action required by the EGD’s climate goals vis-à-vis the strong normative and institutional protection that the ECT affords to foreign fossil fuel investors and that is leading to multi-million dollar investor-state disputes.
